European Commission issues three draft resolutions on electronics and electrical equipment


On September 13, 2006, the European Commission issued a TBT notification on the three draft resolutions on electronic and electrical equipment to the WTO Committee on Technical Barriers to Trade (Notification No.: G/TBT/N/EEC/122). They are:
1. The draft resolution, in order to accommodate the advancement of technology, amend the annex to the European Parliament and Council Directive 2002/95/EC on the exemption of lead and cadmium applications;
2. The draft resolution, in order to accommodate the advancement of technology, amend the annex to the European Parliament and Council resolution 2002/95/EC on the application of exemption from hexavalent chromium;
3. The draft resolution, in order to accommodate the advancement of technology, amends the annex to the European Parliament and Council Directive 2002/95/EC on the exemption of lead in lead-rich glass.
Description of content: Directive 2002/95/EC proposes an obligation for each Member State to ensure that new electronic and electrical equipment placed on the market shall not contain lead, mercury, cadmium or hexavalent from July 1, 2006. Chromium, polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE). However, a series of exemptions are foreseen in its annex. The new draft resolution adds nine exemptions to the annex to Directive 2002/95/EC: eight exemptions for lead (one for cadmium and lead) and one for hexavalent chromium.
Objective and rationale: This revision is in accordance with Article 5(1)(b) of Directive 2002/95/EC. The urgent reason is due to the fact that the material ban under Directive 2002/95/EC had entered into force on July 1, 2006. In order to ensure the legal certainty of member states and economic operators in accordance with the statutory applicability of the exemption, the Commission must approve and publish these resolutions as soon as possible.
Proposed date of adoption and proposed date of entry into force: Deadline for approval of comments at the end of September 2006: 30 days from the date of distribution.
